The rules of the electronic store www.mynameisadancer.com define the conclusion of the purchase contract and the obligations of the parties.
1.1. These purchase and sale rules (hereinafter - the Rules) determine the mutual rights, duties and responsibilities of the person who purchases goods in the online store www.mynameisadancer (hereinafter - the Buyer) and the seller, when the Buyer purchases goods in the online store. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.
2.1. The purchase and sale contract between the Buyer and the Seller is considered to be concluded from the moment the Buyer creates a shopping cart in the electronic store, specifying information about himself: name, surname, delivery address, e-mail address. e-mail address, phone number, and after choosing a payment method and familiarizing yourself with these Rules, click the "Order" button, and it is valid until the full fulfillment of the obligations under this contract. In cases where the Buyer does not agree with all or a certain part of the Rules, he must not place the order.
3.1. The Seller has the right to temporarily or indefinitely terminate the operation of the electronic store, having previously notified the Buyer and undertakes to send the ordered goods for which the Buyer has already paid.
3.2. The seller has the right to unilaterally change these Rules by publishing the changed Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.
3.3. The seller has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
4.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the electronic store. The seller does not make any guarantees that the online store will operate without interruption or that data transmission will be error-free. The Seller is not responsible for any losses of the Buyer related to malfunctions of the electronic store and/or data transmission errors.
4.2. The seller undertakes to send the goods ordered to the buyer within 3-10 working days from the payment of the goods.
4.3. The seller undertakes to replace the goods purchased by the user free of charge, if they are of the wrong size, with similar goods of different dimensions, shape, color, model or complexity. If the Seller does not have clothes suitable for replacement, the Buyer has the right to return the clothes to the seller and recover the price paid for them. In this case, the Seller undertakes to return the money paid to the Buyer within 10 working days and is released from responsibility for non-delivery of the goods.
4.4. The seller undertakes to comply with other requirements set forth in these rules.
5.1. The buyer has the right to buy goods in the electronic store in accordance with these Rules and the legal acts of the Republic of Lithuania.
5.2. The buyer (user) has the right to cancel the contract for the purchase and sale of goods concluded in the electronic store with the Seller by notifying the Seller in writing within 14 working days from the day of delivery of the goods. The buyer has the right to withdraw from the contract for the purchase and sale of goods with the seller only if the goods are of high quality, have not been damaged and have not substantially changed their appearance.
5.4. The buyer has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
6.1. The buyer must pay the price of the goods and their delivery, as well as other payments (if specified when concluding the contract) and accept the ordered goods
6.2. The goods are started to be produced and the Seller undertakes to execute the sales contract only when the Seller receives a notification from the Buyer's bank about the completed payment for the selected goods.
6.3. The buyer must comply with other requirements established in the Rules and legal acts of the Republic of Lithuania.
7.1. The buyer is responsible for the correctness of the data provided. The buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided.
7.2. The parties are responsible for the violation of the purchase and sale contract concluded using the electronic store in accordance with the procedure established by the legal acts of the Republic of Lithuania.
7.3. The seller is not responsible for the fact that the color, shape or other parameters of the goods displayed in the online store do not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
7.4. The seller is not responsible for changes in the quality of the garment if the buyer used the garment without following the washing and other care instructions specified on the label.
7.5. With this contract, the Seller warns that the color, structure or other properties of the fabric may change when the garment is worn or washed.
7.6. In the event of damage, the guilty party compensates the other party for the direct losses incurred due to its fault.
8.1. By clicking the "Order" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree to provide the Seller with his personal data and does not object to the Seller processing the personal data provided by the Buyer and/or his representatives for the purposes of identification of representatives, conclusion of contracts, execution (online trade) and direct marketing. The Seller indicates that the Seller will not process the personal codes of the Buyer (if he is a natural person) and his representatives for the purpose of direct marketing.
8.2. By clicking the "Order" button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives are informed of their right to access their personal data processed by the Seller and how they are processed, demand correction, destruction of their personal data or suspension of their personal data data processing actions, when the data is processed in violation of the provisions of the law, to object to the processing of their personal data.
8.3. By pressing the "Order" button, the Buyer confirms that he and his representatives know that they have the right to refuse to provide their personal data, but understand that personal data are necessary and necessary in order to unambiguously identify the Buyer and/or his representatives for the conclusion and execution of contracts (online shopping ) purposes and without providing personal data and/or not consenting to their processing for the above purposes, will not be able to conclude and/or execute the contract.
9.1. The Seller sends all informational messages and notices for direct marketing purposes to the e-mail address provided in the Buyer's registration form.
9.2. The Buyer sends all messages and questions using the data provided in the Seller's online store.
10.1. The Buyer and the Seller agree that all information that is provided on the Seller's online store website (including, but not limited to, these Rules, information about the Seller, the offered goods and services and their characteristics, the Buyer's right to refuse the purchase and sale contract implementation procedure, the Seller's product maintenance services and guarantees (if they are provided)) are considered to be provided to the Buyer in writing.
10.2. All disagreements arising from or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. If it is not possible to reach an agreement, disagreements are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
